John Patrick Punch

On 12 March 2008 the Legal Services Division of the Administrative Decisions Tribunal handed down its findings with respect to an information filed by the New South Wales Bar Association in respect of John Patrick Punch.

The Tribunal found John Patrick Punch guilty of professional misconduct in that in June 1995 John Patrick Punch adduced evidence in criminal proceedings knowing it to be untrue.

On 12 March 2008 the Tribunal made the following orders:

  1. John Patrick Punch is guilty of professional misconduct;
  2. the decision of the Tribunal be published;
  3. John Patrick Punch to pay the costs of the Bar Association as agreed or assessed; and
  4. both parties to file and serve submissions on penalty within 14 days of the decision.

On 21 May 2008 the Tribunal published its judgment on penalty.  The Tribunal made the following orders:

  1. The name of John Patrick Punch be removed from the roll of persons admitted as lawyers maintained by the Supreme Court of New South Wales;
  2. The practising certificate of John Patrick Punch be cancelled;
  3. John Patrick Punch pay the costs of the Bar Association as agreed or assessed; and
  4. the decision of the Tribunal be published.

The local practising certificate of John Patrick Punch was cancelled immediately following delivery of the judgment on Wednesday, 21 May 2008.
