On 23 September 2008, in matter numbers 072012, 072013, 072014 and 072046, the Legal Services Division of the Administrative Decisions Tribunal found Jan Peniston Butland:
- guilty of professional misconduct by submitting to the Legal Aid Commission an invoice claiming sums for 'Preparing Court documents' and 'Disbursements General' to which he was not entitled (the 'Bartholomew' matter, proceedings 072046);
- guilty of professional misconduct by sending to the Bar Association a letter dated 16 November 2005 containing statements which he knew to be false (the '16 November 2005 letter' matter, proceedings 072046);
- guilty of unsatisfactory professional conduct by sending to the Legal Aid Commission an invoice claiming a sum in excess of that to which he was entitled (the 'Hatton' matter, proceedings 072013);
- guilty of professional misconduct by sending a letter advising a client to act in a false and misleading fashion in relation to prison authorities by pretending to have 'panic attacks' (the Ell' matter, proceedings 072012);
- guilty of professional misconduct by sending a letter to the Bar Association dated 11 May 2005 in the course of its investigation of the 'Ell' matter which contained false statements concerning a non-existent medical report (the 'Bar Association investigation' matter, proceedings 072014).
On 15 June 2009 the Administrative Decisions Tribunal made the following orders:
(a) that Jan Peniston Butland's name be removed from the local roll;
(b) that Jan Peniston Butland's local practising certificate be cancelled;
(c) that Jan Peniston Butland pay the applicant's costs of the proceedings in the Tribunal.
